Even though on paper it may seem simple for the P65


break away and form their own division or association, it may not be that simple. The P65 have enough teams for some sports (i.e. football, men's basketball, women's basketball, etc). However, they do not have enough teams for other sports (i.e. ice hockey, water polo, men's soccer, women's soccer, lacrosse, etc). You may say "big deal" because football is driving the train now so who cares about the non-revenue sports. On the surface that would be a fair assumption to make regarding the situation.

Where the P65s care about it is in the legal system. If the P65 allow non-P65 schools to play in certain non-revenue sports and deny non-P65 schools to play in basketball or football (even if those schools are willing to play by the P65's rules), then the P65 could be looking at quite a few lawsuits. Maybe even quite a few antitrust lawsuits which could bring a lot more undesired attention to "big time college athletics." If the P65 are truly going to form their own division level or association, then they must make sure they have enough participating teams in each of the sponsored sports before they can make their move. In addition, they also must be mindful of Title IX and make sure they comply with it because that could be something else that derails the train before it has an opportunity to leave the station.
